2. General Provisions2.1 Definitions

• Seller: CYBER SHARK, providing digital software licenses, including pre-owned (“second-hand”) licenses.
• Buyer: Any individual or legal entity purchasing products through cybershark.md.
• Products: Transferable digital software licenses delivered electronically with accompanying documentation.

2.2 Applicability

These Terms and Conditions form an integral part of the sales contract and apply to all transactions made through cybershark.md.

2.3 Governing Legislation

• Applicable consumer protection and contractual laws of the Republic of Moldova.
• EU Directive 2009/24/EC on the legal protection of computer programs, which allows the resale of software licenses within the European Union.

3. Products and Limitations

3.1 Definition of Products

All software licenses sold are pre-owned and transferable under EU law. Products are delivered electronically, without any physical media (CD/DVD).

3.2 Authenticity and Compliance

CYBER SHARK guarantees that all licenses are genuine, valid, and compliant with the manufacturer’s specifications.

3.3 Usage Limitations

• Products may be used only in accordance with the manufacturer’s terms of use.
• Licenses cannot be activated on multiple devices simultaneously unless explicitly allowed by the manufacturer.

⚠️ Important Notice:

If the product has been previously activated, registered, or linked to a manufacturer account due to the client’s error or misuse, it cannot be returned, replaced, or refunded.

4. Ordering Process4.1 Placing an Order

Orders can be placed directly via the website or by email, providing all required details.

4.2 Order Confirmation

A sales contract is considered valid once CYBER SHARK sends an order confirmation by email.

4.3 Additional Verification

CYBER SHARK reserves the right to request additional documentation from legal entities to verify proper software usage.

5. Prices and Payments

5.1 Prices

All displayed prices include VAT and applicable taxes. Any additional costs (such as expedited electronic delivery) will be clearly indicated before checkout.

5.2 Payment Methods

Payments may be made by:

• Bank transfer
• Online payment systems (e.g. PayPal, Stripe)

6. Refund and Return Policy

6.1 Legal Exceptions

According to EU Directive 2011/83/EU and Moldova Law No. 105/2003, digital products delivered electronically cannot be returned once:

• Delivery has started with the Buyer’s prior consent; and
• The Buyer has acknowledged the loss of the right of withdrawal.

6.2 Product Warranty and Replacement

In the event of technical issues:

• The Seller will replace the product with a functional one;
• If replacement is not possible, a refund will be issued within 14 working days.

7. Warranty

7.1 Warranty Period

All products are covered by a 12-month warranty for consumers.

7.2 Warranty Conditions

The warranty applies only if:

• The license is used according to the manufacturer’s instructions;
• The Buyer provides complete documentation (invoice and proof of purchase).

8. Personal Data Protection

8.1 Applicable Regulations

All personal data is processed in compliance with:

• Law No. 133/2011 on personal data protection (Republic of Moldova);
• EU General Data Protection Regulation (GDPR).

8.2 Purpose of Data Processing

Data is collected and used solely for:

• Contract fulfillment and order delivery;
• Issuing invoices and related documentation.

9. Jurisdiction and Dispute Resolution

9.1 Consumers

All disputes involving consumers shall be resolved under Moldovan law by the competent courts of the Republic of Moldova.

9.2 Legal Entities

For business clients, all disputes shall be settled under the laws of the Republic of Moldova by the competent courts in Chișinău, unless otherwise agreed in writing between the parties.

10. Limitation of Liability

10.1 CYBER SHARK shall not be liable for:

• Incorrect product use by the Buyer;
• Financial losses resulting from incompatibility between the software and the Buyer’s systems.

10.2 The warranty becomes void if the product is used in violation of the manufacturer’s terms.

11. Final Provisions

11.1 Modifications

Any updates to these Terms and Conditions will be published on cybershark.md and take effect immediately upon publication.

11.2 Severability Clause

If any provision is found invalid or unenforceable, the remaining provisions shall remain in full effect.
